WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

EVENT: Fallbrook 2-4-6 Fitness Competition

DATE: September 13, 2026

LOCATION: REINS Therapeutic Horsemanship, Fallbrook, CA

1. IDENTIFICATION OF RELEASED PARTIES

In consideration of being permitted to participate in the Fallbrook 2-4-6 Fitness Competition (the "Event"), I, the undersigned, hereby release, waive, and discharge the following parties:

The Daniel Ferguson Memorial Foundation * Country Strong * REINS Therapeutic Horsemanship (the "Venue")
All Event Coaches, Judges, and Volunteers * Their respective officers, directors, employees, agents, and representatives (collectively referred to as the “Released Parties”).

2. ASSUMPTION OF RISK

I acknowledge that the Event involves high-intensity functional fitness movements, including but not limited to: heavy lifting, sandbag carries, sled pulls, sprinting, and movements on uneven dirt surfaces. I understand that these activities involve inherent risks of serious bodily injury, including:

Muscle strains, joint injuries, and bone fractures.
Heat-related illnesses (heat exhaustion or heat stroke).
Cardiovascular incidents (heart attack or stroke).
Permanent disability, paralysis, or death.
Property damage or loss.

I VOLUNTARILY AND FREELY CHOOSE TO INCUR ALL RISKS associated with the Event, whether known or unknown, even if arising from the ordinary negligence of the Released Parties.

3. RELEASE AND WAIVER OF LIABILITY

I hereby release and forever discharge the Released Parties from any and all claims, demands, or causes of action for personal injury, death, or property damage arising out of my participation in the Event or my presence at REINS Therapeutic Horsemanship, including claims caused by the ordinary negligence of the Released Parties. This waiver does not apply to gross negligence, willful misconduct, or intentional acts.

4. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, costs, or expenses (including attorney fees) arising from my participation in the Event or any damage I may cause to the property of REINS Therapeutic Horsemanship.

5. PHYSICAL CONDITION & MEDICAL CONSENT

I represent that I am in good health and proper physical condition to compete in high-intensity exercise. I authorize the Released Parties to secure emergency medical treatment for me if necessary and agree to be responsible for all costs associated with such treatment.

6. MEDIA RELEASE

I grant the Daniel Ferguson Memorial Foundation and Country Strong the right to use my image, voice, and likeness in photographs or videos taken during the Event for promotional and social media purposes without compensation.

7. CALIFORNIA CIVIL CODE SECTION 1542 WAIVER

I expressly waive any rights I may have under California Civil Code Section 1542, which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”

8. DIGITAL SIGNATURE & ELECTRONIC CONSENT

By clicking "I Agree" or typing my name below, I acknowledge and agree that:

I am electronically signing this Waiver and Release of Liability, Assumption of Risk, and Indemnity Agreement.
My electronic signature is the legally binding equivalent of my handwritten signature.
I have full authority to sign this document for myself (or as the parent/legal guardian of a minor participant).
I consent to be legally bound by the terms and conditions of this agreement in its electronic form.
I have had the opportunity to save or print a copy of this agreement for my records.
